In a recent trial, a Florida state court jury could not reach a verdict on whether Johnson & Johnson’s talc products cause cancer, resulting in a mistrial. The lawsuit, brought by Bob Sugarman, alleged that J&J’s talc-based baby powder led to his wife’s ovarian cancer and subsequent death. J&J maintains that their baby powder is safe, asbestos-free, and does not cause cancer. However, the company faces over 50,000 lawsuits regarding its talc products, predominantly by women with ovarian cancer.

These cases were put on hold for two years as J&J sought to resolve its talc liabilities in bankruptcy court with a proposed $8.9 billion settlement. Despite two dismissed bankruptcy filings, litigation resumed last year. J&J is considering moving the talc cases into bankruptcy for a third time to facilitate a resolution.

Although some trials have resulted in significant plaintiff victories, including a $2.1 billion judgment in 2021, other verdicts have been overturned due to unreliable expert witness testimony. In response to the increase in lawsuits and concerns about the safety of talc-based products, J&J ceased selling talc-based baby powder in favor of cornstarch-based alternatives.

The company’s decision to shift away from talc products underscores the contentious legal battles and public perception challenges it faces. With ongoing litigation and potential bankruptcy proceedings looming, the future of J&J’s talc-related cases remains uncertain.
