Delhi HC issues Contempt of Court notice to Go First airlines' resolution professional

In a recent development, the Delhi High Court has issued a show-cause notice to the resolution professional (RP) of Go First airline for allegedly disobeying judicial orders. The notice asks why contempt proceedings should not be initiated against him for failing to allow inspection and maintenance of lessors’ aircraft. This decision was made by Justice Tara Vitasta Ganju during a hearing of the case.

The RP’s counsel mentioned that they were willing to comply with the maintenance of the aircraft, and the court has scheduled further hearings on March 15. The High Court was addressing a petition filed by one of the lessors, DAE (SY22) 13 Ireland Designated Activity Company, who claimed that the RP was not maintaining the aircraft and restricting inspection and document scrutiny by the lessors.

Several other lessors have raised similar concerns about the RP’s non-compliance with court orders. The petitioner accused the RP of intentionally neglecting regular maintenance and inspections of aircraft and failing to provide necessary documents. The RP, on the other hand, disputed these claims and stated that they were working towards compliance with the court’s orders.

This legal battle stems from Go First’s voluntary insolvency resolution petition filed in May 2023. The airline has been facing challenges, with lessors seeking deregistration and repossession of leased planes. The situation has left the carrier grounded since May 3, 2023, impacting its operations and leaving many stakeholders in limbo. The court’s decision to issue a show-cause notice highlights the complexities and disputes surrounding the airline’s resolution process.
